OFFICER.REQUEST FOR TRANSFER OF CASE SUIT NO.MOS/7171C/2012 BEFORE
MAGISTRATE HABIBAT BASHIRU OUT OF HER COURT
Committee for Democracy and Rights of the People(CDRP) is one of the
leading human rights organizations in Nigeria and husband of Miss
Jimoh Basirat Olabisi is our strong member.
CDRP acknowledged the effort of the present administration under the
able leadership of Ogbeni Rauf Aregbesola and State Acting Chief
Judge,Justice Gloria Oladoke to sanitize the judicial system of the
state from illegality,corruption and deprivation of another right.It
is very unfortunate that some people are still not wanted to change
from their past and think that they can manipulate anything to satisfy
their desire.
It is our responsibility as stakeholder to draw your attention to a
criminal case with suit No:Mos/717c/2012,between Commissioner of
Police and Jimoh Basirat Olabisi,on a frame up case now fraudulently
been substituted with another charge from Ministry of Justice with
suit No:Mos/802c/2012:State vs. Jimoh Basirat Olabisi.
The aforementioned case was originally slated for trail on Monday3rd
December,2012 in which a witness in person of Mr George Daramola
Oyeniran,the Director of Administration,Ladoke Akintola University Teaching
Hospital,Osogbo was called to a witness box after sworn to an oath of the
court where he was cross examined by the Police Prosecutor,Sergeant Elaisha
Olusegun for one hour twenty five minutes(1hrs 25 mins) before Magistrate
Habibat Bashiru.
The said Presiding Magistrate adjourned ruling till December 5th,2012
after Mr.George Daramola Oyeniran tendered uncertified document before the
court in which the the counsel to the accused person,Barrister K.B.Odedeji
opposed.Surprisingly,the case took a new dimension on December 5th,2012
when the ruling that supposed to come before any other matter on the case
was deliberately abandoned by Magistrate Habibat Bashiru and later admitted
another charge illegally brought by another Lawyer from Ministry of
Justice,Mr Rotimi Faremi,What a compromise?
CDRP equally want to inform you that the Chief Medical
Director(CMD),Professor Solomon Olufemi Fadiora and the Management
team of the LAUTECHTH have vowed that the poor lady will end up in
Ilesa maximum prison at the end of the case which we see as prejudice
to the sanctity of Justice.Evidence for this is readily available for
verification.
OUR INTEREST
CDRP has it on record the hanky panky game of Mrs.Oluwatosin Omosalewa
Olawepo,legal officer to LAUTECH Teaching Hospital,Osogbowho is
watching brief in the case for teaching hospital,now connived with
police to circumvent justice,using her office as an opportunity to
influence justice.
It will interest you that the said legal officer paid an unscheduled
visit to Magistrate Habibat Bashiru in her private residence in
company of her husband on Monday 3rd December,2012 evening at exactly
9.30pm to the and also ,we noticed that undue influence was mounted
on Ministry of Justice which resulted to forcefully taking over of the
case file and satanic sudden substitution of the charge in which
Magistrate Habibat Bashiru conceded to their plead and suspended the
ruling earlier fixed for 5th of December,2012 and admitted the new
charge fraudulently cooked by Ministry of Justice.
The conduct of Mrs.Oluwatosin Omosalewa Olawepo ,the legal official to
LAUTECHTH,Osogbo is similar to that of James Ibori's (The former
governor of Delta State) lawyer,Mr Bhaadresh Gohil,who is also a
partner at Arlington Sharmah Solicitors UK,who was sentenced to 7
years imprisonment for conspiracy to make false instrument and undue
influence to influence justice.
The courageous Honourable Justice Christopher Hardy who sentenced
Ibori's Lawyer,Gohil to seven years imprisonment ,in his ruling
described Gohil as "Architect and predicate offenders in thoroughly
dishonest scheme"
Also,we would remind our respected State Chief Judge,the misconduct of
Mr Kunle Kalejaiye ,in the case of Rauf Aregbesola& 2 Ors. Vs.
Olagunsoye Oyinlola&Ors.,where a counsel to Mr Aregbesola ,Mr Ajibola
Bashiru in the petition to National Judicial Council(NJC) seeking
that Justice Thomas Naron led first Osun State Election Petition
Tribunal should disqualify its elf from the said tribunal on the
allegation of conspiracy and trying to influence justice in favour of
Brigadier General Olagunsoye Oyinlola led government.
To frustrate the case further, a long adjournment was granted by
Magistrate Habibat Bashiru from 5th of December ,2012 till January
23rd 2013 for hearing of the case as against ruling for 5th
December,2012 on uncertified document tendered by police prosecutor.
"As third eye of the people,it is our joint responsibility to protect
the rule of law and ensure that justice should not be for sale,as the
judgement of God is supreme.The law is to protect the citizens of
Nigeria and should not be used unjustly to perpetrate and to inflict
punishment on poor and innocent citizen.
The case must be heard on merit and judgement should not be for
highest bidder."The conduct of Magistrate Habibat Bashiru is a
testimony to the fact that there can never be a justice on the case.it
is erroneous believe that individual can not fight injustice
perpetrated by government institution and get justice even when the
citizen rights is violated.Institution should not be fvaoured against
citizens when erred as there can not be institution without citizens.
We shall therefore in this circumstance urged that the justice must
not only be done but must see to have done in this case.

Some of us are watching. Some of us are keeping records. Some of us are conscious of what people will say and write in the condolence register. The register that will serve as reference on the Day of Judgement, when political associates will not be given opportunity by Almighty to solicit. This is another litmus text for Ogbeni Rauf Aregbesola. Are we saying the Motto "Osun Ipinle Omoluabi" is fake?
